Workplace Application: This workshop will provide a broad overview of the various laws that govern employee benefit plans for the novice or expert.

ERISA is the foundation for all the plans that you provide to your employees. This workshop will provide an overview of the ERISA mandates, the plan documents and other communication requirements, the reporting and compliance mandates as well as the fiduciary obligations. The general requirements under the Internal Revenue Code, COBRA, HIPAA, and other laws that pertain to employee benefits will also be discussed. Finally, learn how to apply FMLA, ADAAA, FLSA and other employment laws to illustrate how these laws intersect as well as their effect on employee benefits. This workshop will help you understand:

  • The overall structure so you can apply employee benefit laws to specific situations.
  • What a plan document is, what a a summary plan description is, the differences between them and their importance.
  • The relevancy of the fiduciary obligations of a plan sponsor.
  • The requirements of HIPAA and COBRA and how to manage employee benefit plans to maintain compliance with both of these laws.
  • The basics of the FMLA, FLSA and ADAAA and how to maintain compliance with those rules and their interaction with the employee benefit plans.

Jay has more than 30 years of experience as a tax attorney specializing in employee benefits.  Prior to joining World, Jay was a Sr. VP and Senior ERISA Attorney with Lockton was previously the national practice leader for the legal and research team at WT.W

Jay served as a Peace Corps volunteer and business consultant from 1979 to 1982. 

He has an LL.M.  in taxation from New York University School of Law, J.D. with distinction from the University of Arizona College of Law and a BSBA from Washington University in St. Louis.  Jay is the former Chair of the American Benefits Council, an adjunct professor of employee benefits in the LL.M. program at Washington University School of Law.

Jason Sheffield is BRPs National Director of Compliance for the Baldwin Regulatory Compliance Collaborative. He oversees the ongoing evolution of our firm's national compliance operations. Jason develops, designs and implements educational programming and compliance assuredness services by creating timely and relevant solutions designed for the benefit of our clients and colleagues, our industry partners, and the general benefits community. Jason has practiced employee benefits law and consulting for nearly two decades, representing individual, corporate, and tribal interests at the local, state, and federal levels. He has advised clients and provided representative services before administrative agencies such as the DOL, the IRS, CMS, OCR, several state-level treasury authorities, and others. He has experience with both qualified and non-qualified retirement plans, executive compensation matters, and extensive experience respecting health and welfare plan matters. Jason received his undergraduate degree from Georgia State University (magna cum laude) and his Juris Doctor from Western New England College School of Law. He is admitted to the State Bar of Georgia.
