Sailing the Rocky Seas of the Current Intra-Company Transfer Climate

Attendees will learn about the numerous hurdles at the USCIS and the consulates in transferring multinational employees to their U.S. companies; strategies to overcome those obstacles to meet strategic business needs and provide informed support and guidance to transferees; and ways to avoid unnecessary costs throughout the process. This session will particularly focus on the current state of the L-1B process for both consular processing and USCIS filings.

As the business needs of companies have evolved, it has become both common and necessary for organizations to transfer executives, managers and employees from non-U.S. entities to the U.S. to ensure meaningful, consistent and effective expertise and management within the company. However, companies can face numerous hurdles in this process. This session will identify best practices for L-1B success, detail the challenges of filing with the USCIS and of consular processing, and define “specialized knowledge” vs. “advanced knowledge” with regard to the L-1B process.

Derek Quashie is a Partner in the Immigration Practice at PwC Law LLP working out of the Toronto office. Derek has over 10 years of experience practicing US immigration law in the capacity of outside counsel providing services to large multinational corporations as well as in-house counsel for a large global media conglomerate. His additional experience in law includes several years practicing employment litigation in New York City. He has also spent many years as a strategic corporate human resources partner for several large organizations in both Canada and the US. Derek received his Bachelor’s degree in Criminology from the University of Toronto and his Juris Doctorate degree from Benjamin N. Cardozo School of Law. He is licensed to practice law in both New York and Ontario. Because of his extensive and diverse employment history, Derek is known by clients to provide well-rounded and practical legal and business advice that not only complies with the law but adapts to various business practices and cultures.

Manish Daftari is a Director within the Immigration Practice at PwC Law with over 12 years of immigration law experience. He currently oversees immigration services for PwC Law.

Manish advises clients on corporate immigration compliance, oversees the development and implementation of their policies, and assists companies in keeping their immigration programs competitive. Manish is an expert in the full array of employment-based immigration benefits available to foreign nationals who seek to work in the U.S., and further counsels on permanent residency and citizenship.  

Manish represents individual clients in personal immigration matters, as well as private businesses in establishing immigration policies and immigration compliance practices which are tailored to meet a range of business needs. Manish has represented applicants at the United States Citizenship and Immigration Services (USCIS), the US Department of Labor, and the US Consulates. He has also represented clients in front of Immigration Court.

Manish has lectured frequently on diverse immigration law topics at corporate events and meetings, as well as at client presentations and conferences. 

Manish is a member the American Immigration Lawyers Association (AILA), the California Bar Association and was formerly an Executive Committee member of the AILA Canada Chapter. Prior to joining PwC Law, Manish practiced for many years in San Francisco, California.
