Addressing Texting, Sexting and Virtual Nonsense at Work & After Hours

Attendees will learn about the evolving landscape with electronic communications and behaviors and how it impacts the workplace.

Using interactive technology, case studies and videos, Karen Michael will explain the evolving landscape for using social media in recruitment, the employer's rights to rescind or deny employment based on a candidate's social media use and employee misuse of social media and other electronic formats at work and after hours, including how the First Amendment and National Labor Relations Act apply, if at all.  She will also discuss the legal and cultural issues that have arisen with the virtual workplace, including inappropriate conduct and harassment via virtual platforms.

  • Lean the risks and benefits associated with searching applicant social media use in recruitment.
  • Understand the employer's rights to rescind or deny employment to candidates based on information.
  • Hear when the First Amendment applies to disciplining or terminating an employee for using social media when working for a public sector employer.
  • Understand when the National Labor Relations Act applies to disciplining or terminating an employee for using social media when working for a private sector employer.
  • Discuss unique issues that have arisen with the virtual workplace and how to address them, including improper attire and conduct during virtual meetings, and virtual harassment.
