Attendees wil learn about what's new regarding the FLSA's overtime pay requirements in terms of DOL regulatory and enforcement initiatives, and how employer's can minimize their exposure for unpaid overtime.

The Department of Labor is aggressively taking steps to alter who's exempt vs. non-exempt, who's an employee vs. an independent contractor, what's compensable vs. non-compensable time, and how overtime is to be calculated. These developments and related policy and enforcement initiatives will be addressed, as well as various COVID vaccine/testing wage and hour issues. In addition, significant FLSA developments from the courts and Congress will be covered. FLSA compliance is the goal, and compliance equates to surviving DOL audits and the wrath of the plaintiffs' bar.  Along these lines,  costly overtime compliance mistakes that employers often make but can avoid will be identified, along with ways to significantly reduce if not eliminate unpaid overtime liability and litigation costs.

Learning Objectives:

  • Learn what employers need to know about recent changes to the FLSA's rules, changes arising from new regulations, new DOL opinions or other guidance, and significant court rulings.
  • Learn what the DOL and Congress is considering towards broadening the scope of who is entitled to overtime pay and changing how overtime pay is calculated.
  • Learn about significant judicial developments under the FLSA and how these developments may impact their operations.
  • See how you can modify your payroll, time and attendance policies to better conform to the FLSA and thereby greatly lessen your employer's financial exposure -- in terms of unpaid overtime, liquidated damages, and attorneys' fees --  to mistakes that otherwise could have been anticipated and avoided.

Robert A. Boonin is a member of the national law firm of Dykema Gossett and is based in its Ann Arbor office. Rob is an honors graduate from The University of Michigan Law School, holds a Masters in Labor and Industrial Relations from Michigan State University, and a BS in Economics from the University of Pennsylvania’s Wharton School.  Practicing law for nearly 40 years, Rob has litigated employment law matters before federal and state courts across the nation, handles all forms of union matters for employers, and regularly counsels clients on such issues as discrimination, FMLA compliance, and wage and hour law. 

Rob is a recognized leader in his field.  For instance, he is: on the Chambers USA list of top employment law attorneys; listed as a Best Lawyer in Employment Law; repeatedly recognized as one of Michigan’s “Super Lawyers”; a Fellow and a Past-President of the Litigation Counsel of America; a Past Chair of  the national Wage and Hour Defense Institute; a Past Chair of the Michigan Bar Association’s Labor and Employment Law Section; and a Fellow of the distinguished American College of Labor and Employment Lawyers.  Rob also in an immediate past-chair of the American Bar Association’s Federal Labor Standards Legislation Committee (which covers FLSA matters), and serves as an Editor of the most recognized authority on the FLSA, the Bloomberg BNA legal treatise – The Fair Labor Standards Act.
